Terms & Conditions for Customers
Welcome to Trusted Local Pro!
These Terms and Conditions (“Terms”) govern your use of the Trusted Local Pro platform and services. By using our platform, you (“Customer”) agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not access or use our services.
1. Definitions
- Trusted Local Pro: A digital platform owned and operated by Trusted Local Pro, connecting users (homeowners, businesses) with local professionals (service providers) for home improvement and skilled trades services.
- Customer: An independent contractor, licensed business, or service provider offering professional services through Trusted Local Pro.
- User: An individual or business seeking services, who enters into a separate agreement with the Customer.
- Professional Services: Services including painting for home or commercial work.
- Service Fee: A fee payable by the Customer to Trusted Local Pro for using the platform and receiving job leads.
- Contract for Work: A legally binding agreement between the Customer and the User outlining the scope and terms of a service. Trusted Local Pro is not a party to this contract.
2. Our Role
Trusted Local Pro acts solely as a facilitator — providing a platform for Customers to receive qualified leads and manage communications with Users. We are not an employer, contractor, or party to any service contract formed between Customers and Users.
3. Agreement Structure
By registering and using Trusted Local Pro, you enter into a business relationship with us. This includes access to our platform, job leads, payment processing, customer support, and account tools.
As a customer:
- You agree to pay a service fee (outlined in section 8).
- You are fully responsible for all services provided to Users.
- You are not authorized to represent or speak on behalf of Trusted Local Pro in any capacity.
4. Your Relationship with Users
When you accept a job through Trusted Local Pro, you enter into a direct, independent agreement with the User (Contract for Work). You are solely responsible for:
- Job quality and professionalism
- Timely communication and service delivery
- Handling any disputes, changes, or material agreements with the User
Trusted Local Pro is not liable for your agreements with Users, or any claims, damages, or disputes arising from those services.
5. Accepting Jobs & Setting Prices
- You are free to accept or decline any job offered.
- Job estimates are initially generated by our system but may be revised before starting the work, subject to User approval.
- All price and scope changes must be confirmed in writing with the User before the job begins.
6. Use of Third-Party Workers
If you use subcontractors or employees (“Professionals”) to complete work, you remain fully responsible for:
- Their conduct, quality of service, and compliance with laws
- Maintaining appropriate supervision and accountability
7. Performance Standards & Ratings
- Users may rate your services after job completion.
- You must maintain an average rating above the minimum set by Trusted Local Pro.
- Poor performance, repeated complaints, or negative ratings may result in your suspension or removal from the platform.
8. Fees & Payments
- Trusted Local Pro charges a service fee as a percentage of each completed job.
- We handle payments from Users on your behalf. This means:
- You authorize Trusted Local Pro to collect payments for your jobs.
- You will be paid bi-weekly for completed jobs, minus the service fee.
- You are responsible for providing accurate banking information.
- Invoices and receipts are issued by us on your behalf. Any disputes must be reported within 3 business days of issue.
9. Legal & Tax Responsibility
As an independent contractor or business:
- You are responsible for your own tax filings, insurance coverage, and legal compliance.
- You must maintain all licenses, permits, and insurance required for your trade in your region.
- You must provide your own tools, transportation, and resources for every job.
10. Confidentiality & Conduct
You agree to:
- Keep all client information, pricing, and platform data confidential.
- Represent yourself and your business honestly and professionally.
- Not misuse the platform or upload harmful, illegal, or false content.
11. Non-Compete Clause
You agree not to directly solicit or work with Users from Trusted Local Pro outside the platform for a period of 6 months after your last job through the platform. Violations are subject to a contractual penalty of $7,000 per breach.
12. Suspension & Termination
We reserve the right to:
- Suspend or terminate your account for poor conduct, fraud, safety concerns, or breach of these Terms.
- Update these Terms with 30 days’ notice. Continued use after that period implies your acceptance of changes.
- You may terminate your account at any time with 30 days’ written notice.
13. Dispute Handling & Debt Collection
If a User fails to pay you:
- Trusted Local Pro may assist with debt recovery.
- You authorize us to act on your behalf to communicate with Users and recover outstanding amounts.
- Funds recovered will be transferred to your account, minus any applicable costs or service fees.
14. Contractual Penalties
The following penalties may be applied in case of breach:
- Failure to complete a confirmed job: Up to $700 per incident
- Confidentiality breach: $3,000 per incident
- Non-compete violation: $7,000 per incident
15. Final Provisions
- Governing Law: These Terms are governed by the laws of the province or territory in which Trusted Local Pro operates (e.g., Ontario, Canada).
- Severability: If any part of these Terms is found to be unenforceable, the rest remains valid.
- Entire Agreement: These Terms form the complete agreement between you and Trusted Local Pro regarding your use of the platform.
